WHEREAS, the Auto Repair Garage and Second Hand Dealer - Motor Vehicle Parts licenses held by AAA Enterprise, Inc. d/b/a Affordable Tire (License ID #20120004026) for the premises located at 1118-7th Street East in Saint Paul were the subject of a Notice of Violation dated September 16, 2014, stating that during an inspection of the licensed premises on June 13, 2014, a DSI Inspector documented violations to license conditions #2, #3, #8, #15, and #19; and
 
WHEREAS, during a re-inspection conducted on August 28, 2014, a DSI Inspector documented violations to license conditions #2, #3, #8, #10, #15 and #19, which were many of the same license condition violations that were found during the June 13, 2014 inspection; and
 
WHEREAS, a second re-inspection conducted on August 29, 2014, found the licensee had brought the premises into compliance with most of the license conditions but was still in violation of license condition #10; and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did not respond the Notice of Violation to pay the $500.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a hearing by September 26, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, AAA Enterprise, Inc. d/b/a Affordable Tire is hereby ordered to pay a matrix penalty of $500.00 for license condition violations documented by a DSI Inspector during inspections on June 13, 2014; August 28, 2014 and August 29, 2014.   Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
