Approving adverse action against the Auto Body Repair/Painting Shop license held by Duqueiro Cano, d/b/a Duke's Cars & Towing at 323 Maria Avenue.

WHEREAS, the Auto Body Repair/Painting Shop license held by Duqueiro Cano d/b/a Duke's Cars & Towing (License ID #20120001127) for the premises located at 323 Maria Avenue in Saint Paul was the subject of a Notice of Violation dated May 16, 2014, stating that during an inspection of the licensed premises on April 21, 2014, a DSI Inspector documented violations to license conditions #6, #7 and #8; and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did not respond the Notice of Violation to pay the $500.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a hearing by May 27, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Duqueiro Cano d/b/a Duke's Cars & Towing is hereby ordered to pay a matrix penalty of $500.00 for violations to license conditions #6, #7 and #8 documented by a DSI Inspector on April 21, 2014. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
