Approving a request by 1221 University Avenue, LLC to release a slope easement over a portion of the property at 1221 University Avenue West.
Body
WHEREAS, a request has been received from 1221 University Avenue, LLC for the release of existing easements for slopes, cuts and fills in the grading of Griggs Street within the property depicted on Exhibit A attached hereto, and legally described as:
Except the West 25 feet, Lot 24 and all of Lots 25 through Lot 30, Block 32, Syndicate No. 5 Addition to St. Paul, County of Ramsey, State of Minnesota
; and
WHEREAS, the easement rights requested to be released, which currently encumber part of Lot 30, are legally described as
That portion of the Slope Easement per document number Book 4 of Plans, Page 45, Block 32, Syndicate No. 5 Addition to St. Paul, County of Ramsey, State of Minnesota, according to the recorded plat thereof
; and
WHEREAS, the Saint Paul Department of Public Works has determined that said easements, as they apply to the above property, may be released; now, therefore be it
RESOLVED, that with the accompanying Certificate of Intended Non-Use, filed voluntarily on behalf of the Department of Public Works for the City of Saint Paul and made a part hereof by this reference, the City for itself and on behalf of said Department, waives its right to the easements described above; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, said easement rights are released and the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the City Clerk shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution.
