Authorizing the declaration of flood control and sewer easements across city-owned property at Harriet Island Regional Park.
Body
WHEREAS, the City of Saint Paul ("City") is the fee owner of real property located at 75 West Water Street and 85 West Water Street, within and adjacent to Harriet Island Regional Park; and
WHEREAS, as part of the City's flood protection responsibilities, administered by the Department of Public Works Sewer Division, the City must possess the necessary property rights over all levees, floodwalls, pumping stations and other related facilities used by the City for flood control purposes; and
WHEREAS, the City, in cooperation with the Army Corps of Engineers, has identified a portion of the City Property that has been constructed and maintained by the City for flood protection but is not encumbered with flood control or sewer easements; and
WHEREAS, the City desires to designate and declare a flood control easement within the City Property ("Declaration of Flood Control Easement"), as set forth in Exhibit A attached hereto, and described and depicted in Exhibit B attached hereto; and
WHEREAS, the City desires to designate and declare a sewer easement within said the City Property ("Declaration of Sewer Easement"), as set forth in Exhibit C attached hereto, and described and depicted in Exhibit D attached hereto; now, therefore be it
RESOLVED, that the Council of the City of Saint Paul hereby authorizes the proper city officials to execute said Declaration of Flood Control Easement and Declaration of Sewer Easement, and to record said easements with the Ramsey County Registrar of Titles and/or Recorder's Office.
