Disposing of property at 7th Street East and Kittson Street.

WHEREAS, the City of Saint Paul ("City") owns land located at 7th and Kittson, PID number 322922310062 ("City Parcel"), as depicted on Exhibit A; and
WHEREAS, Jay Montpetit ("Property Owner") of 520 7th St E, St Paul, MN 55101, owns land adjacent to the City Parcel's southeasterly border, and is requesting the City's disposal and Property Owner's purchase of a 9,000 square foot area of the City Parcel which has been improved as a parking lot ("Disposal Property"), based upon a negotiated sale price of $27,000 as stated in an independent property appraisal; and

WHEREAS, the Disposal Property is intended to be a replacement property for a previously owned Montpetit parking lot that was purchased by the State of Minnesota ("MNDOT") for the Lafayette Bridge project; and

WHEREAS, the City has not used said Disposal Property because it has been encumbered by a MNDOT temporary easement for the Lafayette Bridge project and the construction of Kittson Street; and

WHEREAS, the City has determined the Disposal Property is surplus land, and may be vacated and discontinued as public property; and

WHEREAS, the City wishes to convey the Disposal Property to the Housing and Redevelopment Authority of the City of Saint Paul ("HRA") for subsequent sale to said Property Owner, as provided in the three-party Acquisition Agreement attached hereto as Exhibit B; now, therefore be it

RESOLVED, that the Disposal Property is hereby vacated and discontinued as public property; and be it further

RESOLVED, that the proper city officials are hereby authorized and directed to dispose of said Disposal Property, by quit claim deed, to the HRA for subsequent conveyance to said Property Owner; to execute said Acquisition Agreement in a form and content substantially as set forth in Exhibit B, a copy of which is on file in the Office of Financial Services-Real Estate Division, file number 17-2012; and ...
