Granting a stay in the enforcement of Council File No. RLH RR 13-12, an Order to Raze and Remove the Structures at 1220 VIRGINIA STREET.
Body
WHEREAS, in the matter of the Order to Raze and Remove  the Structures at 1220 Virginia Street, the Saint Paul Council granted 15 days for the razing and removal of the building(s) at this property as property owner was not able to provide adequate materials confirming ownership and financial ability to complete the rehabilitation; and
 
WHEREAS, in the City Council's deliberation on this matter, Councilmembers indicated their willingness to reconsider the issue, should clear ownership and proof of financing be provided;
 
WHEREAS, City demolition of the property was delayed, pending the outcome on subsequent litigation of this matter, which has now been resolved; and
 
WHEREAS, code compliance inspection was performed on June 26, 2012 and a $5,000 performance deposit was provided to the Department of Safety and Inspections (DSI) on October 11, 2013;
 
WHEREAS, the Legislative Hearing Officer has reviewed ownership documents associated with 1220 Virginia Street and found that ownership is exclusively held by Michael Russo; and
 
WHEREAS, the Legislative Hearing Officer has also reviewed financial documents provided by Mr. Russo, which confirm the financial where-with-all to complete the project; and
 
WHEREAS, the Legislative Hearing Officer recommends, based on the new and previously-provided information, that time be granted for the rehabilitation of this property; now, therefore, be it
RESOLVED, that the City Council grants a 180 stay in the implementation of Council File No. RLH RR 13-26; and be it further
RESOLVED, that the City Council allows that the code compliance inspection, dated June 26, 2012, be allowed for use in this project.
