Approving the release of utility easements at 370 University Avenue.
Body
WHEREAS, St. Paul Old Home Plaza, LLC, owner of 370 University Avenue West, as depicted and described in Exhibit A, has requested the release of existing utility easements within the vacated public alley crossing its property, as depicted in Exhibit A and described as:
All of the vacated alley in Block 1, Elfelt, Bernheimer and Arnolds Addition to St. Paul; and
WHEREAS, the easement rights requested to be released are stated in Saint Paul City Council Resolution CF 84-1650, approved December 11, 1984, and in Ramsey County document #2259972, recorded April 12, 1985; and
WHEREAS, Xcel Energy has determined that said easement, as it applies to the above property, may be released; and
WHEREAS, CenturyLink has determined that said easement, as it applies to the above property, may be released; now, therefore be it
RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of CenturyLink and Xcel Energy, the City hereby waives their right to the easement(s) described above; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee said easement rights are released and the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution.
