WHEREAS, adverse action was taken against the Tree Trimmer & 1 Vehicle and Tree Trimmer - Each Add'l Vehicle licenses held by CB Industries, Inc. d/b/a Arbortech Stump & Tree Removal (License ID #20110004042) for the City of Saint Paul, by Notice of Intent to Suspend Licenses dated February 20, 2013, alleging licensee failed to pay delinquent license and late fees of $467.00, and submit the following information: 1) current vehicle information; 2) current certificate of General Liability insurance; 3) proof of registration with the Commissioner of Agriculture; 4) proof that one of their employees possesses certification as an arborist from the ISA and 5) a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to pay the delinquent license and late fees and submit required information or request a hearing; and
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to pay the delinquent license and late fees and submit required information or request a hearing by March 1, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Tree Trimmer & 1 Vehicle and Tree Trimmer - Each Add'l Vehicle licenses held by CB Industries, Inc. d/b/a Arbortech Stump & Tree Removal are hereby suspended for failure to pay delinquent license and late fees of $467.00.
