WHEREAS, adverse action was taken against the Restaurant (1) - No Seats license application submitted by Super Stop #1, Inc. d/b/a D & L Food And Gas (License ID #20090001469) for the premises located at 626 Larpenteur Avenue West in Saint Paul, by Notice of Intent to Deny License dated January 25, 2013, alleging the licensee failed to pay the required Environmental Health Inspection Fee and obtain the required inspection approval from a Department of Safety and Inspections (DSI) Environmental Health Inspector; and
WHEREAS, the licensing office recommended license denial; and
WHEREAS, the licensee did not respond to the Notice of Intent to Deny License to contact DSI in order to pay the Environmental Health Inspection Fee and obtain the required inspection approval from an Environmental Health Inspector, request a hearing or withdraw the license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to pay the Environmental Health Inspection Fee and obtain the required inspection approval from an Environmental Health Inspector, request a hearing or withdraw the license application by February 4, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Restaurant (1) - No Seats license application submitted by Super Stop #1, Inc. d/b/a D & L Food And Gas is hereby denied.
