WHEREAS, adverse action was taken against the Retail Food (A) Grocery 1-100 sq. ft. license application submitted by Tou Kao Yang d/b/a Tou Kao Yang (License ID #20110005056) for the premises located at 217 Como Avenue, Unit D12 in Saint Paul, by Notice of Intent to Deny License dated January 23 2013, alleging the licensee failed to obtain a DSI Environmental Health Inspection approval; and
WHEREAS, the licensing office recommended license denial; and
WHEREAS, the licensee did not respond to the Notice of Intent to Deny License to obtain the required approval, request a hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to obtain the required approval, request a hearing or withdraw his license application by February 4, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Retail Food (A) Grocery 1-100 sq. ft. license application submitted by Tou Kao Yang d/b/a Tou Kao Yang is hereby denied.
