Granting the request of George Enright to proceed in forma pauperis concerning his appeal of the September 18, 2012 determination of his dog as potentially dangerous by writ of Certiorari to the Minnesota Court of Appeals.

WHEREAS,  George Enright wishes to appeal the determination of his dog, Quigley, as potentially dangerous pursuant to a writ of certiorari to the Minnesota Court of Appeals; and
      WHEREAS, Mr. Enright has presented financial information to support his request to proceed in forma pauperis during the course of that appeal; and
      WHEREAS,  Minn. Stat. § 563.01, subd 3 states that upon a finding that the appeal is not of a frivolous nature, a litigant shall be allowed to proceed in forma pauperis if his annual income is not greater than 125 percent of the poverty line established under United States Code, Title 42,  §9902(2); and
      WHEREAS, Mr. Enright has submitted to the Department of Safety and Inspections a copy of his 2011 tax returns showing that he is eligible to proceed in forma pauperis ; now, therefore, be it
      RESOLVED, that the Saint Paul City Council authorizes Mr. Enright to proceed in forma pauperis for his appeal of the September 18, 2012 determination of his dog as potentially dangerous by writ of certiorari to the Minnesota Court of Appeals.
