WHEREAS, adverse action was taken against all licenses held by Attucks-Brooks American Legion Post #606 d/b/a Attucks-Brooks American Legion Post #606 (License ID #0023519) for the premises located at 976 Concordia Avenue in Saint Paul on August 22, 2012, based on Licensee's failure to resolve a tax clearance issue with the Minnesota Department of Revenue; and

WHEREAS, by Notice of Intent to Suspend Licenses dated August 22, 2012, Licensee was notified that additional adverse action would be taken against all licenses based on Licensee's failure to pay $1,557.00 in delinquent license and late fees; and

WHEREAS, the Notice of Intent to Suspend Licenses was served on Licensee by U.S. First Class Mail and Licensee's last known address; and

WHEREAS, on August 27, 2012, the Notice of Intent to Suspend Licenses sent by the City Attorney's Office was returned by the United States Postal Service "return to sender not deliverable as addressed unable to forward"; and

WHEREAS, Department of Safety and Inspections staff went to the licensed premises and noticed a "For Sale" sign and an eviction notice posted on the building which was closed at the time; and

WHEREAS, the Department of Safety and Inspections has not received a Clearance Certificate from the Minnesota Department of Revenue indicating the licensee resolved the tax clearance issue; and

WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to pay the delinquent license and late fees of $1,557.00 or request a hearing; and

WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to resolve the tax clearance issue and pay the delinquent license and late fees or request a hearing by September 3, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
