Approving adverse action against all licenses held by Fasika, Inc., d/b/a Fasika Ethiopian Restaurant, 510 Snelling Avenue North.

WHEREAS, adverse action was taken against all licenses held by Fasika, Inc. d/b/a Fasika Ethiopian Restaurant (License ID #20010000419) for the premises located at 510 Snelling Avenue North in Saint Paul, by Notice of Intent to Suspend Licenses dated August 22, 2012, alleging licensee failed to submit gross receipts for food and beverages from the previous twelve (12) months as required by Saint Paul Legislative Code § 409.15(e); and
WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to submit the required information or request a hearing; and
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to submit the required information or request a hearing by September 3, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that all licenses held by Fasika, Inc. d/b/a Fasika Ethiopian Restaurant are hereby suspended and will remain suspended until the licensee submits gross receipts for food and beverages from the previous twelve (12) months as required by Saint Paul Legislative Code § 409.15(e).
FURTHER RESOLVED, the licensee is also ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the license. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
