Approving adverse action against the Gas Station license application submitted by and the Cigarette/Tobacco and Retail Food (B) Grocery licenses held by Nahal Taninim, LLC, d/b/a Capitol Gateway, 236 Grand Avenue.

WHEREAS, adverse action was taken against the Gas Station license application submitted by and the Cigarette/Tobacco and Retail Food (B) Grocery 101-1000 <tel:101-1000> sq. ft. licenses held by Nahal Taninim, LLC d/b/a Capitol Gateway (License ID #20110003685) for the premises located at 236 Grand Avenue in Saint Paul, by Notice of Intent to Deny License and Notice of Intent to Revoke Licenses dated August 22, 2012, alleging on May 24, 2012, the licensee's building was determined to be unoccupied and the Certificate of Occupancy was revoked by the Department of Safety and Inspections - Fire Inspection Division; and
WHEREAS, on August 8, 2012, the building was assigned as a Category 2 (Commercial Vacant Building) and placed on the vacant building list; and
WHEREAS, per Saint Paul Legislative Code ยง 40.01 a Certificate of Occupancy is required in order to occupy a building and operate a business in the City of Saint Paul; and
WHEREAS, the licensee did not respond to the Notice of Intent to Deny License and Notice of Intent to Revoke Licenses to request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Deny License and Notice of Intent to Revoke Licenses stated that if the licensee failed to request a hearing by September 3, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that Gas Station license application submitted by Nahal Taninim, LLC d/b/a Capitol Gateway is hereby denied; and
FURTHER RESOLVED, the Cigarette/Tobacco and Retail Food (B) Grocery 101-1000 <tel:101-1000> sq. ft. licenses held by Nahal Taninim, LLC d/b/a Capitol Gateway are hereby revoked.
