Allowing additional extended work periods at the request of Metropolitan Council as provided by the sound level variance RES PH 12-15 allowing Central Corridor Light Rail construction, with restrictions, between 10:00 p.m. and 7:00 a.m. from March 27, 2012 to December 31, 2012 on Cedar Street between 7th Street and 11th Street.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and
WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and
WHEREAS, Kevin Ryan, Manager of Transitways Construction, Metropolitan Council, has been designated as the responsible person on the application; and
WHEREAS, in order to minimize disruption to businesses, the public and adjoining property owners, the applicant is seeking additional extended work hour periods as provided for by RES PH 12-15, for the hours of 10:00 p.m. to 7:00 a.m. between January 19, 2012 to December 31, 2012; and
WHEREAS, if applicant is not granted additional extended work hour periods, they will not be able to complete construction within a timeline that would minimize disruption to businesses, the public and adjoining property owners; and
WHEREAS, the Department of Safety and Inspections have reviewed the application and have made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants additional extended work hour periods to the Metropolitan Council, subject to the following conditions:
1) The variance shall be for up to twenty-five (25) additional extended work hour periods that begin at 10:00 p.m. and end at 7:00 a.m. starting March 27, 2012 through December 31, 2012.
