Purpose of Appeal
These windows were installed prior to me purchasing the house nine years ago.  I purchased in good faith that all permits for changes were pulled.
All new windows that I have put in have had permits pulled by "New Windows for America."  
Windows in question are newer, less than 15 years, and open/close easily.  They are in good repair.

Body
WHEREAS, in the matter of the Appeal of Thomas J. Schrauth to a Fire Certificate of Occupancy Inspection Correction Notice at 228 VICTORIA STREET NORTH, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 2-inch variance on the openable height of the egress window in Unit 2; deny the appeal on the egress window in Unit 3; and grant an extension for 90 days to come into compliance; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
