WHEREAS, a request has been received from Community Dental Care for the release of easements for existing slopes, cuts and fills within the property, legally described as:
Lots 16, 17, 18, 19 and 20, Block 2 Wilder's Addition St Paul, Minnesota, County of Ramsey
and Lots 13, 14 and 15, Block 3, Wilder's Addition St Paul, Minnesota, County of Ramsey
WHEREAS, the easement rights requested to be released are stated and depicted in recorded Ramsey County documents in Book 41 of Plans on Page 40; and Book 54 of Plans on Page 44; and
WHEREAS, the Saint Paul Department of Public Works has determined that said easement, as it applies to the above property, may be released; now, therefore be it
RESOLVED, that with the accompanying Certificate of Intended Non-Use, filed voluntarily on behalf of the Department of Public Works for the City of Saint Paul and made a part hereof by this reference, the City for itself and on behalf of said Department, hereby waives all rights to the easement described above; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder, and that the City Clerk shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution.
