Approving adverse action against the Auto Body Repair/Painting Shop license held by Heartland Auto Sales, Inc., d/b/a Heartland Auto, 877 Westminster Street.

WHEREAS, adverse action was taken against the Auto Body Repair/Painting Shop license held by Heartland Auto Sales, Inc. d/b/a Heartland Auto (License ID #20060002711) for the premises located at 877 Westminster Street in Saint Paul by Notice of Intent to Revoke License dated February 16, 2012, alleging that on January 24, 2012, during an inspection of the licensed premises, the licensee was cited for several license condition violations by an inspector for the Department of Safety and Inspections (DSI); and
WHEREAS, this is the fourth (4th) violation to the license conditions within the past twenty-four (24) months; therefore, pursuant to Saint Paul Legislative Code ยง 310.05 (m) (1) the licensing office recommended revocation of his Auto Body Repair/Painting Shop license; and
WHEREAS, on March 13, 2012, after a discussion between the licensee's attorney and the Assistant City Attorney, a notice was sent placing the item on the agenda for a public hearing before City Council which was held on May 2, 2012; now therefore be it
RESOLVED, that the Auto Body Repair/Painting Shop license held by Heartland Auto Sales, Inc. d/b/a Heartland Auto is hereby immediately revoked for license condition violations cited during an inspection of the licensed premises on January 24, 2012 and identified in the Notice of Intent to Revoke License.
This resolution, and action taken above, is based upon facts contained in the February 16, 2012 Notice of Intent to Revoke License sent to the licensee and the arguments made at the public hearing on May 2, 2012.
