WHEREAS, in the matter of the Appeal of Ying Vang, on behalf of Johanna Lee, to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 754 SIXTH STREET EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 2-inch variance on the openable height and a 1-inch variance on the openable width of the main floor second window; grant a variance on the sill height in the main floor second window provided three permanently fixed steps are installed below the egress window (5"-7" in height and full width) - tread must be a minimum of 10" in depth; grant a 2-inch variance on the openable height of the upper floor west bedroom egress window; grant a 4.5-inch variance on the openable height of the stairway landing egress window provided the window remains un-obstructed; and the window in the upper floor north bedroom must open to 16 inches in width; if not, grant 90 days for compliance; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
