WHEREAS, in the matter of the Appeal of Ryan Ferguson, on behalf of Ryan Partners, to a Fire Certificate of Occupancy Inspection Correction Notice at 667 OTSEGO STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 4-inch variance on the openable height of the egress window in the bedroom of Unit 2 and grant a 4-inch variance on the openable height of the egress window in the west bedroom of Unit 1; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
