Title

Fifth Making finding on the appealed substantial abatement ordered for 939 CHARLES AVENUE in Council File RLH RR 24-6.

 

Body

WHEREAS, the City Council adopted RLH RR 24-37 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 939 Charles Avenue; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case under RLH RR 24-6 on February 13 and 27, 2024 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated, but recommended that the City Council continued the performance $5,000 performance deposit and granted an additional 180 days for the completion of the abatement; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case again under RLH RR 24-36 on September 24 and continued City Council Public Hearings to October 16, November 6, 20, December 4 and 18, 2024 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated and therefore the City Council forfeited the entire $5,000 performance deposit; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case again on January 14, 2025 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were [abated/were abated]; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is [abated and the matter resolved / not abated and therefore authorizes the Department of Safety and Inspections to proceed with this substantial abatement].
