Body
WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota ("HRA") owns property located at 1433 University Avenue West which is land formerly part of the Midway Chevrolet site in Hamline Midway District 11 area ("the property"); and
WHEREAS, the HRA currently has a license agreement with Constantino Real Estate LLC for parking on the property for local businesses dated March 16, 2011 ("parking license agreement"); and
WHEREAS, Hollis Lynne Monnett, Trustee ("Trustee") owns the adjacent business at 1415 University Avenue known as the Townhouse Bar ("Townhouse Bar"); and
WHEREAS, the Townhouse Bar has had outdoor patio seating on the sidewalk area along University Avenue but the seating area is narrow and pedestrian congestion is a problem; and
WHEREAS, the Trustee has requested use of a small portion of the property which is in the area subject to the parking license agreement and which is adjacent to 1415 University for the purpose of developing a patio seating area; and
WHEREAS, Constantino Real Estate LLC ("Constantino") as holder of the current license agreement has agreed to an amendment of the current parking license agreement with the HRA to release a portion of land within the parking area so that Trustee and HRA can execute a separate license agreement for development of that area for patio seating which terms include Consent to the use of the property used for parking as an emergency exit route for pedestrians from the property; and
WHEREAS,  Trustee would execute a license agreement with the HRA ("patio license agreement") and will be responsible for development of the site as well as comply with the requirements for final site approval by the City, insurance, maintenance and the other terms and conditions set forth by the HRA at its' own cost.
 
NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota that:
1. The Patio License Agreement is hereby approved contingent upon: (a) final site plan review and approval, (b) development of the site as determined in the site plan, (c.) execution of amendment to Parking License Agreement, (d.) meeting all terms and conditions set forth in the license agreement with HRA  including right to terminate agreement upon 30 day notice by either party or if not terminated before, agreement will terminate on October 31, 2014.
2. The execution and delivery of the Patio License Agreement between Hollis Lynne Monnett, Trustee under a Living Trust dated September 10, 2002 and the HRA is hereby authorized by the Board of Commissioners and such agreement is to be executed by the Chairperson/Commissioner of the HRA.
