Resolution Approving Sale and Conveyance of Land to City of Saint Paul for Properties Located within ISP/NSP Neighborhoods Identified Parcels 670 Rose Avenue and Parcel 676 Rose Avenue, Payne-Phalen District 5

WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (HRA), has duly adopted and there is now lawfully in effect in the City of Saint Paul, Minnesota, a City Wide Comprehensive/Redevelopment Plan (Plan) providing for the acquisition, clearance and resale of land for redevelopment which includes Dayton's Bluff District 4 area within the Plan and the City Consolidated Five-Year Plan; and
WHEREAS, on August 8, 2007, by Resolution No. 07-08/08-3 HRA approved the Invest Saint Paul Initiative including a work plan and budget covering (1) organization Support/Community Outreach; (2) Rehabilitation; (3) Mortgage Financing-incentives; (4) Strategic Acquisition; (5) Neighborhood Commercial Corridors; (6) Large Redevelopments; and (7) Supportive Housing; and
WHEREAS, on January 23, 2008, by Resolution 08-01/23-9 and on February 25, 2009, by Resolution No. 09-02/25-6 HRA authorized the Executive Director to enter into purchase agreements, accept donated property and execute all necessary documents in order to complete closings on properties to be acquired as strategic acquisitions under both ISP and NSP Programs under the ISP Initiative; and
WHEREAS, the increased economic stress these neighborhoods are under with high vacancy and foreclosures creates an opportunity to secure strategic properties in accordance with the NSP Programs and the Strategic Acquisition Criteria that has been identified and guides the selection of properties for acquisition and addresses the issues and concerns identified by the communities through an extensive neighborhood outreach effort undertaken through the Invest Saint Paul Initiative; and
WHEREAS, there were two properties located at 670 Rose and 676 Rose directly adjacent to the planned Payne-Maryland Recreation/Library facility to be constructed (collectively the "Parcel") and was reviewed in combination with the District Council and others when being considered for strategic acquisition under the ISP activities; and
WHEREAS, City of Saint Paul is moving forward with the construction of the Payne Maryland Recreation/Library facility and has requested transfer of Parcel for combining all properties needed for the construction and received the support of from the Payne-Phalen District 5 Community Council , and is now ready to move forward with the purchase/redevelopment of the Parcel; and
WHEREAS, said proposal, pursuant to due notice thereof was published in the Saint Paul Pioneer Press on March 3, 2012, and a public hearing on said proposal and proposed sales and provisions thereof, was held on Wednesday, March 14, 2012 at 2:00 p.m., Central Daylight Time, third floor City Hall, 15 West Kellogg Boulevard, in the City of Saint Paul, Minnesota; and
WHEREAS, the HRA, pursuant to the provisions of Minnesota Statutes, Section 469.029 and 469.032 agrees to sell the Parcel for use in accordance with the Invest Saint Paul Initiative and work plan which meets the activities identified in the City Wide Redevelopment Plan and City Consolidated Plan; and
WHEREAS, the disposal price of the Parcel is in accordance with and subject to the restrictions of the Invest Saint Paul Initiative and NSP, City Wide Redevelopment Plan and Consolidated Plan which takes into consideration the improvement of community space improving the quality of life in a community that affects all neighborhood residents and enhances children activities; and
NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota as follows:
1. That the proposal by City of Saint Paul, Inc. to purchase the Parcel located in Payne-Phalen District 5 within Invest Saint Paul/NSP Activity areas hereby conforms to the objectives and specific requirements of the Invest Saint Paul Initiative and meets the intended reuse as identified in the City Wide Comprehensive Plan and Consolidated Plan. The Parcels are legally described as:
Parcel 670 Rose Avenue East Lot 7, Block 2, Evans Addition
Parcel 676 Rose Avenue East Lot 6, Block 2, Evans Addition
2. That the method of disposition of the Parcel is in accordance with the ISP/NSP Program and Rebuilding Plan 2009-2013 under the Invest Saint Paul Initiative, City Wide Redevelopment Plan and Consolidated Plan and is the appropriate method of making the Parcel available for redevelopment.
3. That the acquisition of this Parcel in the amount of $1.00 and other good and valuable considerations for a public use is satisfactory and in accordance with Sec. 469.032 and the Neighborhood Stabilization Program requirements and use and restrictions are in conformance with the City Wide Redevelopment Plan and Consolidated Plan.
4. That City of Saint Paul has the qualifications and financial resources to acquire the Parcels in accordance with the Neighborhood Stabilization Program and Rebuilding Plan 2009-2013 under the Invest Saint Paul Initiative.
5. That the proposed disposal transaction by and between HRA and City of Saint Paul is satisfactory in form and complies with the requirements of state and federal law for all Parcels.
6. That City of Saint Paul has received supporting action from the Payne-Phalen District 5 Community Council review and supporting letter for this action.
7. That the sale to City of Saint Paul is in accordance with said Contract Purchase Price and will include use for open space and parking in combination with the construction of the new Payne Maryland Town Center and will retain such a deed restriction to insure compliance with local, state and federal regulations, and is hereby authorized by the Board of Commissioners, to be executed on its behalf by the Chairperson or his or her designated Commissioner of the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota.
