Title

Approving the release of easement rights retained for construction, operation, and maintenance of a public sewer in vacated Valentine Avenue between the east line of Berry Street and the west line of Minnesota Trunk Highway 280.

 

Body

WHEREAS, Ps Mid-West One Llc ("Owner"), dba Hunting Valley Public Storage and PS Mid-West-Hunting Valley Inc., owns or has interest in the property located at 1441 Hunting Valley Road (the "Property"); and

 

WHEREAS, Owner and/ or its assigns plan to improve facilities on the Property and combine its other abutting properties, and has engaged in the City's site plan review process; and

 

WHEREAS, when Valentine Avenue from Berry to Hwy 280 was vacated by City Council No. 246649, on December 11, 1969, an easement was retained for future construction, operation and maintenance of a public sewer; and

 

WHEREAS, in order for the planned improvements to proceed, said easement for future construction, operation and maintenance of a public sewer must be released, except for the east 10 feet said easement; and

 

WHEREAS, the Owner and/ or its assigns has requested the release of above-mentioned easement, subject to the east 10 feet of the easement area being retained, as referenced in said City Council No. 246649; now, therefore be it

 

RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of the City of St. Paul, Department of Public Works, Sewer Division, hereby waives all rights to the above-described easement for future construction, operation and maintenance of a public sewer, except for the east 10 feet of said easement; and be it further

 

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution; and be it further

 

RESOLVED, that all other easements retained, along with the terms and conditions mentioned in said resolution, City Council No. 246649, approved on December 11, 1969, will remain in full force and effect and to fully incorporate the same into the present resolution.
