Title

Third Making finding on the appealed substantial abatement ordered for 655 JESSAMINE AVENUE EAST in Council File RLH RR 22-51.

WHEREAS, the City Council adopted RLH RR 22-51 on September 28, 2022 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 655 Jessamine Avenue East; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on March 28, 2023 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated with building inspections reporting the rehabilitation is 50% to 80% complete, depending on whether there are corrections on the un-inspected trades permits; and

 

WHEREAS, as a result of that hearing, the Legislative Hearing Officer recommends recommended that the City Council 1) grant an additional 180 days, pending submission and approval of updated work plan final inspection May 12, 2023; and 2) continue the $5,000 performance deposit; and

 

WHEREAS, the Legislative Hearing Officer recommends recommended  that if additional time to complete the nuisance abatement is granted that the progress or completion be reviewed review in Legislative Hearing in 180 days at the October 24, 2023 Legislative Hearing in order to develop a recommendation for Council consideration;

 

WHEREAS, the Code Compliance Certificate with Corrections was issued May 17, 2023 and the Legislative Hearing Officer finds that the nuisance condition is abated; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council stays on its finding pending recommendation accepts the finding of the Legislative Hearing Officer that the nuisance is abated and the matter resolved.
