Pertaining to a Permanent and Temporary Easement and Agreement with Roselawn Cemetery and the City of Roseville.

 

 

 

Body

WHEREAS, the Board is the owner of certain property located in the southeast quarter of the southwest quarter of the northeast quarter of Section 14, Township 29, Range 23, in Ramsey County, Minnesota known as the Board’s Dale Street Reservoir Site (the “Board Property”); and

WHEREAS, Roselawn Cemetery is the owner of certain property adjacent to the northwest of the Board Property (“Reservoir Woods Park”); and

WHEREAS, Reservoir Woods Park is leased to and maintained by the City of Roseville; and

WHEREAS, excess stormwater from Board Property flows downhill through a portion of Reservoir Woods Park causing erosion of an adjacent hillside; and

WHEREAS, to help alleviate the erosion that may be caused by the stormwater exiting Board Property, construction of storm sewer and drainage infrastructure routing the excess stormwater safely to the nearby wetland will be provided by the Board; and

WHEREAS, staff has prepared an agreement to define the portion of the Reservoir Woods Park property that the parties agree will be subject to the Board’s permanent storm sewer and drainage easement, its related temporary construction easement, and ongoing maintenance of the drainage system; now, therefore, be it

RESOLVED, that the Permanent and Temporary Easement and Agreement between Roselawn Cemetery, the City of Roseville, and the Board of Water Commissioners of the City of Saint Paul is hereby approved in substantially the form submitted and that the proper officers of the Board are hereby authorized and directed to execute said Agreement on behalf of the Board, following approval by the Assistant City Attorney.
