Pertaining to a Tenth Rider to Agreement with the City of Vadnais Heights allowing the installation of Stormwater Drainage Infrastructure within certain Board-owned property.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul (the “Board”) possesses fee title to certain real estate lying in the Northwest Quarter of Section 31, Township 30 North, Range 22 West, in Ramsey County (the “Premises”); and
WHEREAS, the City of Vadnais Heights entered into an Agreement with the Board dated June 20, 1967 for the purposes of installing certain public works and performing certain operations within Board-owned property in the city of Vadnais Heights; and
WHEREAS, stormwater drainage infrastructure is needed to control stormwater at and near the proposed development known as The Elevage in the City of Vadnais Heights; and
WHEREAS, the Board is willing to grant permission for the construction of the stormwater drainage infrastructure within its property via permit agreement with the development company providing that upon its completion all components of the system within the Board’s property become the property of the City and is maintained by the City thereafter; and
WHEREAS, the City of Vadnais Heights has agreed to accept ownership and maintenance responsibilities for said stormwater drainage infrastructure located in said Premises; and
WHEREAS, staff has prepared a Tenth Rider to Agreement between the Board of Water Commissioners and the City of Vadnais Heights to facilitate the transfer of ownership and maintenance responsibility for said stormwater drainage infrastructure; now, therefore, be it
RESOLVED, that the Tenth Rider to Agreement with the City of Vadnais Heights is hereby approved and that the proper officers of the Board are hereby authorized and directed to execute said Tenth Rider on behalf of the Board, following approval by the Assistant City Attorney.
