Accepting a sidewalk easement from 150 Farwell Yards, LLC in conjunction with a proposed development of 150 Water Street.
Body
WHEREAS, 150 Farwell Yards, LLC ("Property Owner") is planning a commercial housing development (the "Project") within the property located at 150 Water Street on the West Side of the city of Saint Paul (the "Development Property"); and
WHEREAS, as part of the site plan approval process for the project, the Department of Public Works ("Public Works") of the City of Saint Paul ("City") is requiring a permanent sidewalk easement ("Easement") over a portion of the Development Property along Water Street; and
WHEREAS, the Property Owners have agreed to provide the Easement and are now requesting that the City accept the Easement, as provided in Exhibit A attached hereto; and
WHEREAS, Public Works has reviewed and approved the Easement as attached; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby accept the Easement in a form and content substantially as set forth in Exhibit A attached hereto, and does authorize the proper city officials to accept an executed original of same and record with the Ramsey County Recorder's Office and/or Registrar of Titles.
