Title

Suspending the Tobacco License held by Holiday Station Stores LLC at 500 7th Street, for non-payment of the fine imposed under RES 22-1492.

Body

WHEREAS, the Tobacco License held by Holiday Station Stores LLC (“Licensee”) for the premises located at 500 7th Street in Saint Paul (“Licensed Premises”) was on the St. Paul City Council (“Council”) consent agenda on September 28, 2022 under RES 22-1492, herein incorporated as Exhibit 1, and

 

WHEREAS, RES 22-1492 found that a store clerk employed by the licensee sold tobacco to an underage person on July 20, 2022 in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (i); and

 

WHEREAS, RES 22-1492 stated that the $500 fine was to be paid within 30 days of the passage and approval of RES 22-1492; and

 

WHEREAS, after consideration of all information in the record before them, Council adopted RES 22-1492; and

 

WHEREAS, RES 22-1492 was signed by the Mayor and became final on September 29, 2022; and

 

WHEREAS, under RES 22-1492, the $500 fine was due on October 28, 2022; and

 

WHEREAS, the Licensee has failed to pay the $500 fine imposed on the License by RES 22-1492; and

 

WHEREAS, suspension of the Tobacco License held by Holiday Station Stores LLC for the Licensed premises is appropriate until the $500 fine imposed on the License by RES 22-1492 is paid; therefore

 

BE IT RESOLVED that the Tobacco License held by Holiday Station Stores LLC for the Licensed premises are suspended until the $500 fine imposed on the License by RES 22-1492 is paid; and be it

 

FURTHER RESOLVED that the Tobacco License will remain suspended until the $500 fine is paid to the Department of Safety and Inspections imposed under RES 22-1492
