Pertaining to the vacation and termination of a public water utility easement granted to the Board at 1500 Commerce Drive in the City of Mendota Heights.

WHEREAS, pursuant to a Grant of Easement for Public Water Utility Purposes dated April 10, 2019, made by St. Paul Fire and Maine Insurance Company, a Connecticut corporation, and recorded May 13, 2019 as Document No. 3304567 in the Office of the County Recorder of Dakota County, Minnesota (the “Easement”), an easement was dedicated to the Board of Water Commissioners for public water utility purposes over a portion of the real property (the “Property”) legally described as follows:
Lot 1, Block 1, Mendota Heights Business Park 4th Addition, according to the recorded plat thereof, filed and of record with the Dakota County Recorder, Dakota County, Minnesota; and
WHEREAS, the Board no longer requires the Easement for public water utility purposes and desires to vacate and terminate the Easement for the benefit of the Property and all present and future owners thereof, together with their successors and assigns; and
WHEREAS, Staff has drafted a Public Water Utility Easement Vacation and Termination; a recordable document that relinquishes the Board’s rights granted by the Easement; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve the Public Water Utility Easement Vacation and Termination, which releases the Board’s rights granted in that certain Grant of Easement for Public Water Utility Purposes dated April 10, 2019 and recorded May 13, 2019 as Document No. 3304567, and that the proper officers are hereby authorized to execute said Public Water Utility Easement Vacation and Termination on behalf of the Board, following approval by the assistant city attorney.
