Approving the fourth rider to the lease agreement between the City and the Saint Paul Regional Water Services (SPRWS).


Body
WHEREAS, the Board of Water Commissioners (the “Board”) and the Saint Paul Police Department (the “City”) entered into a lease agreement dated the 27th day of June 1978, whereby the City was permitted to construct and maintain a regional canine team training facility (“facility”) for and on behalf of its Police Department on certain Board-owned property at the Board’s McCarron’s Water treatment plant, (“leased premises”) incorporated by reference herein; and


WHEREAS, the lease agreement was for a term of twenty (20) years and to terminate on the 26th day of June 1998; and


WHEREAS, the Board and the City entered into an Amended Lease Agreement dated the 25th day of January 1995, extending the term of the lease agreement for an additional term of thirty (30) years and to expire on the 27th day of June 2028, subject to all terms, covenants and conditions set forth in the lease agreement incorporated by reference hereto; and


WHEREAS, on November 10, 2020, the Board by Resolution 20-1577 (incorporated by reference herein) adopted and approved the Second Amended Lease Agreement for an additional term of twenty-five (25) years and to expire on the 27th day of June 2053, subject to the terms, covenants and conditions set forth in the Amended Lease Agreement; and


WHEREAS, on January 27, 2021, the Saint Paul City Council by Resolution 21-162 (incorporated by reference herein) adopted and approved the Second Amended Lease dated November 9, 2020, extending the term of the Lease to June 27, 2053, subject to all of the terms, covenants and conditions set forth in the Amended Lease; and


WHEREAS, the Lease, as amended from time to time, requires Board approval, authorized in writing, to allow the City to make any changes or additions to the exterior of the canine facility or any other portions of the leased premises; and
