WHEREAS, the Tobacco license held by Northern Tier Retail LLC d/b/a Speedway #4023 (“Licensee”) (License ID# 20100004236) for the premises located at 577 Smith Avenue South was the subject of a Notice of Violation dated August 22, 2022, stating that an Store clerk sold tobacco to an underage person on July 20, 2022, in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (i) and
WHEREAS, per Minn. Stat. § 324.10 (b)(1), the licensing office recommended a $500.00 fine; and
WHEREAS, the licensee responded to the Notice of Violation on September 9, 2022 and requested a public hearing via Electronic Delivery Mail and
WHEREAS, a public hearing was held October 5, 2022 and now, therefore, be it
RESOLVED, Northern Tier Retial LLC d/b/a Speedway #4023 (“Licensee”) (License ID# 20100004236) are hereby ordered to pay a $500.00 fine for the sale of tobacco to an underage person on July 20, 2022.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
