Approving adverse action against the Tobacco License held by Holiday Station Stores LLC (“Licensee”) (License ID# 0016584) at 500 7th Street East.

WHEREAS, the Tobacco license held by Holiday Station Stores LLC (“Licensee”) (License ID# 0016584) for the premises located at 500 7th Street East was the subject of a Notice of Violation dated August 24, 2022, stating that an Store clerk sold tobacco to an underage person on July 20, 2022, in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (i) and
WHEREAS, per Minn. Stat. § 324.10 (b)(1), the licensing office recommended a $500.00 fine; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $500.00 fine or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 fine or request a public or administrative hearing by September 7, 2022, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Holiday Station Stores LLC (“Licensee”) (License ID# 0016584) are hereby ordered to pay a $500.00 fine for the sale of tobacco to an underage person on July 20, 2022.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
