Removing license condition #4 from the Gas Station and Cigarette/Tobacco license held by Embabi & Sons LLC, d/b/a West 7th Street Marathon (License ID #20210002140), for the premises located at 675 Seventh Street West.

WHEREAS, Embabi & Sons LLC, d/b/a West 7th Street Marathon (the “Applicant”), applied for a Gas Station and Cigarette/Tobacco license for the premises located at 675 7th Street West in Saint Paul; and
WHEREAS, the Department of Safety and Inspections (the “Department”) recommended that four conditions be imposed on the license applied for by the Applicant; and
WHEREAS, the Applicant agreed to have all four of the recommended conditions imposed on the license; and
WHEREAS, on March 9, 2022, the Council approved the license with the agreed-to conditions; and
WHEREAS, under section 310.06(c) of the Saint Paul Legislative Code, the Department may impose conditions upon a license only when there is a reasonable basis, regardless of whether the license applicant consents to the imposition of such conditions; and
WHEREAS, although the Department had a reasonable basis to impose conditions #1, #2, and #3 on the applied-for license, it lacked a reasonable basis to impose license condition #4, pertaining to video surveillance; now, therefore, be it
RESOLVED, that the Council does hereby remove license condition #4 from the Gas Station and Cigarette/Tobacco license held by Embabi & Sons LLC, d/b/a West 7th Street Marathon (License ID #20210002140), for the premises located at 675 7th Street West in Saint Paul.
