Title
Amending the 2022 OFS/Real Estate Operating Budget to accept payment from the Minnesota Department of Natural Resources for City Real Estate services and for compensation to the Canadian Pacific/Soo Line Railroad for a permanent easement for the Gateway Trail Project.

Body
WHEREAS, the State of Minnesota Department of Natural Resources ("DNR") and the City of Saint Paul ("City") have executed a Cooperative Joint Powers Agreement (”Original Agreement”) to provide for the construction, operation and administration of a new 0.6 mile long realignment of the Gateway State Trail to extend along and adjacent to Interstate 35E, a state highway, and L’Orient Street, a city street, to connect two existing segments of the Gateway State Trail, a project determined to be a priority of the DNR and City; and

WHEREAS, the Original Agreement has been amended to provide for the inclusion of two properties over which the City has acquired easements and which are required for the proposed construction of the L’Orient Street Realignment of the Gateway State Trail; and

WHEREAS, in order to compensate one of the property owners, the Canadian Pacific/Soo Line Railroad ("Railroad"), for the permanent trail easement over its property, the City must receive payment from the DNR and subsequently provide payment to the Railroad, thus requiring an amendment to the 2022 Operating Budget for the Office of Financial Services Real Estate Section to provide spending authority for the easement compensation; and

WHEREAS, the Mayor, pursuant to Section 10.07.1 of the Charter of the City of Saint Paul, does certify that there are available for appropriation, funds of $17,000 in excess of those estimated in the 2022 Budget; now
