Pertaining to two easements for public water mains granted by Pulte Homes of Minnesota LLC on property located at the Highland Bridge Redevelopment Site in the City of Saint Paul.


Body
WHEREAS, Pulte Homes of Minnesota LLC (“Pulte Homes”) is the owner of certain real property within the development site known as Highland Bridge bound by the west right-of-way line of Woodlawn Avenue, the east right-of-way line of Falls Passage West, the south right-of-way line of Village Way, and the north right-of-way line of Saunders Avenue not including the right-of-way known as Mount Curve Boulevard in the city of Saint Paul (“Blocks 20 and 21”); and
WHEREAS, Pulte Homes is constructing single family rowhomes within Blocks 20 and 21 and construction within these blocks will have a shared alleyway constructed between the townhomes which will have public water main available to the residents on either side of the alleyway; and

WHEREAS, this location of water main reduces future maintenance costs to the Board compared to installing water main in Woodlawn Avenue right-of-way, Mount Curve Boulevard right-of-way, and Falls Passage West right-of-way; and

WHEREAS, within each of these alleyways, Pulte Homes is willing to dedicate a thirty-foot wide strip for the dedication of public water main easements which grant the Board of Water Commissioners of the City of Saint Paul perpetual easement rights over, under, across, and through the said 30-foot strip for public water main purposes; and

WHEREAS, the Attorney’s Office of the City of Saint Paul has prepared a Municipal Utility and Water Services Easement Agreement which accomplishes such dedication of easement rights; now, therefore, be it

RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve the Municipal Utility and Water Services Easement Agreement between the Board of Water Commissioners of the City of Saint Paul, the City of Saint Paul, and Pulte Homes of Minnesota LLC and do...
