Granting a temporary construction easement to the Minnesota Department of Transportation over a portion of HRA owned property at 145 Smith Avenue, District 17, Ward 2

Body

WHEREAS, the City of Saint Paul Housing and Redevelopment Authority ("HRA") owns land at 145 Smith Avenue; and

 

WHEREAS, the Minnesota Department of Transportation ("MnDOT") is using the Property to construct, maintain, and operate the Trunk Highway; and

 

WHEREAS, MnDOT requires a temporary construction easement area at the time of commencement of its Trunk Highway project and terminating December 1, 2024 per the attached Temporary Easement between the HRA and the State of Minnesota; and

 

WHEREAS, MnDOT is offering to purchase said easement for Forty-Three Thousand Four Hundred Fifty and 00/100 Dollars ($43,450.00); and

 

WHEREAS, the Real Estate Manager has determined this to be a fair and reasonable value as determined by an appraisal and agreed to between the HRA and MnDOT; now, therefore be it

           

RESOLVED by the Board of Commissioners of the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, that:

 

                     1.                     The HRA Board hereby authorizes a temporary easement to MnDOT, in a form and content substantially as set forth in Exhibit A attached hereto, and to accept payment for said easement, to be deposited in the proper Department account.

 

                     2.                     The Board Chair, HRA Executive Director or Deputy Director, and the Director of the Office of Financial Services (the “Authorized Officers”), with the Saint Paul City Attorney or the City Attorney’s designee approving as to form, are hereby authorized, in their discretion and at such time, if any, as they may deem appropriate, to execute, on behalf of the HRA, the Temporary Easement and take any other actions in order to complete the transaction.
