Authorizing the City to enter into Agreement PUBW2021-12R with Ramsey County for Right of Way Acquisition related to construction of the Lexington Parkway realignment from Adrian Street to Shepard Road.

WHEREAS, the City of Saint Paul and Ramsey County desire to construct a new Lexington Parkway (County State Aid Highway 51) segment between Adrian Street and Montreal Avenue and to reconstruct Elway Street between Montreal Avenue and Shepard Road and make certain improvements associated with said realignment; and
WHEREAS, the construction of this project includes a roundabout that requires right of way (“ROW”) acquisition; and
WHEREAS, this project has been designated as County State Aid Project 062-651-067 and Municipal State Aid Project 164-020-161; and
WHEREAS, the Saint Paul’s share of the estimated cost of the ROW acquisition for this project is estimated at $738,711; and
WHEREAS, this agreement contains a mutual indemnification clause, which the Council finds necessary and reasonable to reconstruct Lexington Parkway from Shepard Road to Adrian Street and make certain improvements associated with said reconstruction; and
WHEREAS, Saint Paul’s share is budgeted in 2021 as the Lexington - Shepard to West 7th Project; now, therefore, be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into Ramsey County Agreement PUBW2021-12R, a copy of which is before Council and is made a part hereof; and be it finally
RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement.
