Approving adverse action against the Gas Station and Cigarette/Tobacco License held by Holiday Station store LLC (“Licensee”) d/b/a Holiday Station store #5 (License ID# 0014861) at 629 Rice Street.

WHEREAS, the Cigarette/Tobacco and Gas Station license held by Holiday Station store LLC (“Licensee”) d/b/a Holiday Station store #5 (License ID# 0014861) at 629 Rice Street for the premises located at 629 Rice Street was the subject of a Notice of Violation dated July 26, 2021, stating that an Store clerk sold tobacco products to an underage person on June 23, 2021, in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (g) and
WHEREAS, per Minn. Stat. § 461.12 Subd 2, the licensing office recommended a $300.00 Administrative penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $300.00 Administrative penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $300.00 Administrative penalty or request a public or administrative hearing by August 9, 2021, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Holiday Station store LLC (“Licensee”) d/b/a Holiday Station store #5 (License ID# 0014861) are hereby ordered to pay a $300.00 Administrative penalty for the sale of tobacco products to an underage person on June 23, 2021.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
