room could be utilized for something that is not a large party. Is there a path for that
kind of abatement plan?
Moermond: There is a path for that. Just to make a record, this is space within an
office building that's been used for after-hours parties that have involved reported
gunfire, injuries, alcohol, drug use, and excessive occupancy all in a space that does
not have a sprinkler system, fire alarms, smoke detectors, or adequate exiting. It's a
recipe for disaster. For this room to be reused, because it has been condemned, we
discussed in hearing what that could look like. There is the nuisance abatement plan,
which is an old-fashioned thing we used to do where the Police, City Attorney's Office,
and (in this case) Fire Inspections could meet with the owner to discuss the owner's
proposal on how they would not let these situations happen again. These violations
also happened back in 2017. There is advertising stating that the owner himself was
using the space after correction notices told him not to do so. Some suggestions
could be not allowing use after 9pm or having an alarm to immediately notify the police
in an emergency. These could give assurance that public safety is being maintained
and that use can happen again.
Noecker: Could we refer to Legislative Hearing in 3-4 months for adoption of a
nuisance abatement plan?
Moermond: Sorry, I sidetracked a bit there. I ask that Council vote today to uphold the
recommendation on the condemnation and refer the matter to Legislative Hearing in 3
months where we could review an abatement plan. We could then bring a
recommended plan back to Council for you to approve, which could serve as a basis
for the condemnation being lifted.
Shari Moore, City Clerk: That would be the week of May 13-17.
Noecker: That will be my motion, to make the condemnation effective today but allow
a path for the appellant to find a way to have a more suitable use, pending our approval
of the outcome of the Legislative Hearing in 3 months.
