Purpose of Appeal
We are appealing the replacement of two double hungs that will not comply w/egress policy.  Openable height is 19", openable width is 23".  Job also has four other replacements that will not comply but should be approved as an equivalency to the policy.  Please approve.

WHEREAS, in the matter of the appeal of Renewal by Andersen Corporation, on behalf of Max and Elizabeth Schultz, to an Egress Window Non-Compliance Determination at 1958 SAUNDERS AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 1-inch variance on the openable height of four double hung replacement egress bedroom windows measuring 23-3/8 inches high by 30 inches wide, and grant a 5-inch variance on the openable height of two double hung replacement egress bedroom windows measuring 19 3/8 inches high by 23 inches wide; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
