Purpose of Appeal
Windows in bedrooms are replacements measuring 27-1/2 inches x 57 inches, therefore, giving over 1500 square inches of space. These windows are all removable.

Legislative Hearing Resolution
WHEREAS, in the matter of the appeal of Elizebeth Osborne to a Notice of Condemnation Unfit for Human Habitation Order to Vacate 1142 MCLEAN AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, Legislative Hearings were conducted on March 1, March 8, April 5 and May 3, 2011, and the Legislative Hearing Officer recommends that the City Council 1) grant the appeal on the Vacant Building Registration per the Department of Safety and Inspections, and deny the appeal on the Condemnation and Order to Vacate; and 2) grant a 1.5 inch variance in the openable height of the egress window in bedrooms 1 and 2; Now, Therefore, Be it
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
