Purpose of Appeal
The double hung windows don't open to city code specs (Item 3).  They are 3.5" (north window) and 4" (south window) below the minimum height, but they are both 9" wider than the minimum width required and provide 8.7 sq. ft. of glazed area.  The current dead bolt on the front door (Item 4) has a 1/2" throw.  It is part of the original door hardware, unique and specific to the 1920s house.  Appellant would like to keep the lock set and door just as they are as she plans to move back to the house someday.

Legislative Hearing Resolution
WHEREAS, in the matter of the appeal of Georgina E. Frankel to a Fire Inspection Correction Notice at 1439 PALACE AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 3.5-inch variance on the openable height of the egress window in the north bedroom, grant a 3-inch variance on the openable height of the egress window in the south bedroom (item #3), and deny the appeal and grant a 90-day extension on the one-inch throw single cylinder deadbolt lock on front door (item #4); Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
