Purpose of Appeal
Appeal of egress window requirements #3 on the CO correction order. The windows are deficient by less than an inch in height but exceed minimum width requirements by 5 inches and 7 inches respectively. These are the original windows to the home and part of its original character.
Also appealing #8 upper floor as a habitable space. The maximum ceiling height is 6'6", not including skylights installed by a previous homeowner.

Legislative Hearing Resolution
WHEREAS, in the matter of the appeal of Kyle Dalton, Azingo LLC, to a Fire Inspection Correction Notice at 2007 MINNEHAHA AVENUE EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends granting a 1-inch variance on the openable height of the egress windows in the main floor southwest and northwest bedrooms, denying a variance on the ceiling height issue in the upper floor room and shall not be used as sleeping room (the bed must be removed), the gas meter (Item 5) is forthcoming (LHO to review gas meter code) and if denied on gas meter, the Legislative Hearing Officer will recommend six (6) months for compliance; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
