Authorizing the execution of an Access, Parking, and Temporary Construction Easement Agreement with Saint Paul Public Schools.
Body
WHEREAS, the City of Saint Paul (“City”) is owner of property addressed 1850 Sheridan Ave W., known as Homecroft Park (“Premises”); and
WHEREAS, Saint Paul Public Schools (“SPPS”) operates Jie Ming Mandarin Immersion elementary school at 1845 Sheridan Ave W., adjacent to the Premises; and
WHEREAS, because of the configuration of the two parcels, the City and SPPS need various access and property rights on each other’s property; and
WHEREAS, SPPS desires to secure a perpetual access and parking easement on a portion of the Premises for the purposes of drop-off and pick-up lanes and SPPS parking within a portion of the Premises (“Easement Area”); and
WHEREAS, SPPS desires to secure a temporary construction easement to construct improvements in the Easement Area; and
WHEREAS, the City and SPPS have entered into a separate Site Operation Agreement regarding responsibility of day-to-day maintenance and minor repairs of the Easement Area; and
WHEREAS, the proposed Access, Parking, and Temporary Construction Easement and legally described Easement Area is attached hereto; now, therefore, be it
RESOLVED, that the proper city officials are hereby authorized to execute the attached Access, Parking, and Temporary Construction Easement Agreement.
