Making finding on the appealed nuisance abatement ordered for 643 EARL STREET in Council File RLH SAO 23-3.

AMENDED 7/19/23

 

WHEREAS, the City Council adopted RLH SAO 23-3 on January 25, 2023 which granted an extension to July 17, 2023 to abate the storage or use of the construction and other related items in the rear yard at 643 Earl Street; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on July 18, 2023 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions forthcoming were not clearly visible, as the fence gate was closed; however, in viewing the yard through the fence openings, there continued to be a significant accumulation of materials, such as particle boards, pallets, scrap wood, metal venting material and plastic barrels;

 

WHEREAS, the Legislative Hearing Officer finds that the order under appeal indicated the owner should "remove and properly dispose of the scrap wood, PVC pipes, bucket and miscellaneous debris from the rear yard" and it is not possible from the photographs to determine if there has been compliance with that order based on the photographs; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not clearly abated and matter is referred to the Department of Safety and Inspections for consideration of additional enforcement or documentation of compliance.forthcoming, pending the outcome of the July 25 18, 2023 Legislative Hearing.
