Title
Authorizing the City to enter into an agreement (which includes indemnification obligations) with the Minnesota Department of Transportation (MnDOT) for the Capital City Bikeway Phase 1 Project.
Body
WHEREAS, the City has a project to construct the Capital City Bikeway on Kellogg from Jackson to St. Peter; and
WHEREAS, the City requests the State of Minnesota allow construction on the State's Trunk Highway 3 (Robert Street) Right of Way and the State is willing to allow said construction; and
WHEREAS, the City has agreed to provide for routine maintenance upon, along, and adjacent to Trunk Highway 3, the terms and limits of which are defined in said Agreement; and
WHEREAS, the City has agreed to provide for Signal System and Emergency Vehicle Preemption system Operation and Maintenance as defined in said Agreement; and
WHEREAS, the MnDOT Agreement requires the City to indemnify MnDOT; now, therefore, be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into MnDOT Agreement No.1051967 with the State of Minnesota, a copy of which is before Council and is made a part hereof; and be it further,
RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement, which includes an indemnification clause; and be it finally
RESOLVED, that this Resolution does not constitute a binding legal agreement; rather, the action taken herein shall not be effective until said documents are executed by the appropriate official(s) of the City.
