Pertaining to Amendment No. 2 to Lease with Ramsey County extending the leased premises to include parking area improvements at the Charles M. Schulz Highland Arena.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul (“Board”) is owner of property addressed as 750 Snelling Avenue South in the City of Saint Paul (the “Property”); and
WHEREAS, the Board and Ramsey County (“County”) entered into a lease dated January 22, 1973 that permitted the County to construct and operate a community ice arena on a portion of the Property; and
WHEREAS, the 1973 lease was replaced by a lease agreement between the parties dated June 9, 1997, which permitted the County to construct and maintain a second ice arena north and west of the arena built in 1973 (“1997 Lease Agreement”); and
WHEREAS, at its meeting on March 10, 2015, the Board approved an amendment to the 1997 Lease Agreement to allow construction and maintenance of a multipurpose locker room addition; and
WHEREAS, the County has recently completed parking area improvements and expansion of the parking lot directly adjacent to the arena outside of their current leased premises as defined by the 1997 Lease Agreement (“Premises”); and
WHEREAS, the Board and the County wish to expand the Premises to include the parking area expansion and Board staff has prepared an Amendment No.2 to Lease which defines the new leased premises; and
WHEREAS, the assistant city attorney and assistant county attorney have approved Amendment No. 2 to Lease as to form; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve Amendment No. 2 to Lease with Ramsey County for the purpose of expanding the Premises leased to include the newly constructed parking area expansion and does direct and authorize the proper officers of the Board to execute said Amendment on behalf of the Board.
