Title

Authorizing the City to enter into an agreement with MnDOT for the relocation of City owned facilities as part of MnDOT's Trunk Highway 156 (Concord Street) Project from Annapolis to Trunk Highway 52.

 

Body

WHEREAS, MnDOT has a project to reconstruct Trunk Highway 156 from Annapolis to 52; and

 

WHEREAS, the City has storm sewer, sanitary sewer and street lighting facilities within the project area, as shown in Exhibit A of the agreement, that need to be relocated; and

 

WHEREAS, MnDOT has agreed to relocate the facilities as a part of their project; and

 

WHEREAS, the City has agreed to pay MnDOT for the cost of relocating these facilities estimated at $44,103.59; and

 

WHEREAS, the agreement contains an indemnification provision, wherein the City agrees to indemnify and defend the State; and

WHEREAS, the City finds that promise of indemnity is reasonable and necessary for this project; and

 

WHEREAS, the City has agreed to maintain these facilities; now, therefore be it

 

RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into MnDOT Agreement No. 1046020 with the State of Minnesota, a copy of which is before Council and is made a part hereof; and be it finally

 

RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement.
