Title

Accepting a Sidewalk and Public Utility Easement from Snelling Shields LLC and an Emergency Vehicle Ingress/Egress Easement from Central Baptist Church in connection with "The Pitch" commercial development at 427 Snelling Avenue North.

 

Body

WHEREAS, in connection with a new mixed-use development by Wellington Management at 427 Snelling Avenue North (the "Development Property"), on June 5, 2019 the City approved the vacation of an abutting alley and the acceptance of an emergency vehicle ingress/egress easement from the abutting property owners, Snelling Shields LLC ("Developer") and Central Baptist Church ("Church"), as well as the acceptance of a vehicle turnaround easement from the Church (RES PH 19-159); and

 

WHEREAS, as part of the site plan approval process for said development the Department of Public Works ("Public Works) of the City of Saint Paul ("City") is requiring a permanent sidewalk and public utility easement ("Sidewalk Easement") over the southeast corner of the Development Property along Snelling Avenue, as provided in Exhibit A attached hereto: and

 

WHEREAS, the City is also requiring an emergency vehicle ingress/egress easement ("Vehicular Easement") east to west across the Church's property between Roy Street North and the north-south alley east of Roy Street North, as provided in Exhibit B attached hereto; and

 

WHEREAS, the Developer and the Church have executed and provided said easements to the City and are now requesting that the City accept said easements; and

 

WHEREAS, Public Works has reviewed and approved said easements; now, therefore, be it

 

RESOLVED, that the Mayor and Council of the City of Saint Paul do hereby accept the Sidewalk Easement, as set forth in Exhibit A attached hereto, and the Vehicular Easement, as set forth in Exhibit B attached hereto, and authorize the proper city officials to record same with the Ramsey County Recorder's Office and/or Registrar of Titles.
